为了避免交易的双方产生争议时不好处理，合同中要有一个仲裁条款。这就是我们这次要讲的内容。
17. 仲裁条款Arbitration
如果合同双方产生争议，往往有以下几种解决方法：
1） Negotiation 协商，也是最好的解决方式。
2） Consultation / Mediation 调解，这个时候会有第三方的介入。
3） Arbitration 仲裁，会有组织或者机构的介入。
4） Litigation 起诉，会耗费较多的精力、时间甚至金钱。
下面是一份合同中的仲裁条款：
与合同有关的所有争议应先通过友好协商解决。协商不成，可以向中国国际贸易促进会外贸仲裁委员会申请仲裁。仲裁应在上海进行，仲裁委员会做出的裁决为最终结果，双方需共同遵守。任何一方不得到法院或其他部门修改仲裁裁决。仲裁费用由败诉方承担
All disputes in connection with the Contract or the execution thereof shall be settled through friendly negotiations. In case no settlement can be reached through negotiations, the case should then be submitted for arbitration to the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade. The arbitration shall take place in Shanghai and the decision rendered by the Commission shall be final and binding upon both parties; neither party shall seek resource to the law court or other authorities for revising the decision. The arbitration fee shall be borne by the losing party.
